1. Agreement to Terms

These Terms and Conditions (“Terms”) govern your access to and use of testmiles.com and any associated content, features, and services (collectively, the “Site”), operated by Test Miles (“Test Miles,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

2. Changes to These Terms

We may modify these Terms at any time. Changes take effect when posted, and we will update the “Last Updated” date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

3. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

4. The Site and Its Content

Test Miles publishes automotive journalism, including vehicle reviews, road tests, news coverage, video content, audio programming, and related commentary. The Site is provided for general informational and entertainment purposes.

5. Intellectual Property

5.1 Our Content

All content on the Site — including articles, reviews, photographs, video, audio recordings, graphics, logos, the “Test Miles” name and marks, page layouts, and the selection and arrangement of content — is owned by us or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

Certain photographs, video footage, and specifications are provided by vehicle manufacturers and other third parties under license. Those materials remain the property of their respective owners and may carry additional usage restrictions.

5.2 Limited License to You

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use. This license does not include any right to:

  • Reproduce, republish, or redistribute our content, in whole or in substantial part
  • Sell, license, rent, or otherwise commercially exploit any content
  • Create derivative works based on our content
  • Use automated systems — including scrapers, bots, spiders, or data-mining tools — to access, copy, or index the Site, except for search engine crawlers operating in accordance with our robots.txt
  • Use our content to train, fine-tune, or develop machine learning or artificial intelligence models without our express written permission
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notice
  • Frame or mirror any part of the Site without our written consent

5.3 Permitted Quotation

You may quote brief excerpts from our articles for purposes of commentary, criticism, news reporting, or education, provided you attribute the excerpt to Test Miles and include a link to the original page. This does not permit republication of full articles, reviews, or videos.

6. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any connected systems or networks
  • Introduce viruses, malware, or other harmful code
  • Impose an unreasonable or disproportionately large load on our infrastructure
  • Attempt to probe, scan, or test the vulnerability of the Site or breach any security or authentication measure
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Harvest or collect email addresses or other contact information of users for the purpose of sending unsolicited communications
  • Circumvent any content-filtering, access-control, or rate-limiting measure
  • Use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other party’s use of the Site

7. User Content

7.1 Your Submissions

You may be able to post comments or otherwise submit content to the Site (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with the Site and our business, in any media now known or later developed.

7.2 Your Representations

You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third party’s rights or violate any law.

7.3 Prohibited User Content

You agree not to post User Content that is unlawful, defamatory, harassing, abusive, threatening, obscene, hateful, invasive of privacy, infringing, or that contains spam, advertising, or malicious code.

7.4 Moderation

We are not obligated to monitor User Content, but we reserve the right to review, edit, refuse to post, or remove any User Content at our sole discretion, at any time, for any reason or no reason, without notice. We are not responsible or liable for User Content posted by others.

8. Editorial Independence, Press Vehicles, and Disclosures

Test Miles is an independent automotive editorial outlet. In the ordinary course of automotive journalism:

  • Press fleet vehicles. We evaluate vehicles that are loaned to us by manufacturers, typically for a limited period, often with fuel, insurance, and delivery provided by the manufacturer or its press fleet agency. This is standard practice throughout the automotive press. Vehicles are returned at the conclusion of the loan period.
  • Press events. We may attend manufacturer-hosted launch events, drive programs, and press conferences. In some cases, travel, lodging, and meals may be provided or subsidized by the manufacturer or event host, consistent with standard industry practice.
  • Sponsored and partner content. Any content that is sponsored, paid for, or produced in partnership with a brand will be identified as such.
  • Affiliate links. Some links on the Site may be affiliate links, meaning we may earn a commission if you make a purchase through them. This comes at no additional cost to you.
  • Advertising. The Site displays third-party advertising. Advertisers do not review, approve, or influence our editorial content.

None of the above arrangements grants any manufacturer, advertiser, or partner approval rights over our editorial conclusions. Our reviews and opinions are our own.

9. Vehicle Information — No Warranty of Accuracy

Vehicle specifications, pricing, availability, fuel economy figures, performance claims, feature content, warranty terms, and incentive information change frequently and vary by market, model year, trim, options, and dealer.

Information published on the Site reflects our understanding at the time of publication and may become outdated. Always verify current specifications, pricing, and availability directly with the manufacturer or an authorized dealer before making a purchase decision.

We make no representation that any vehicle described on the Site is available in your market or at any stated price.

10. No Professional Advice

Content on the Site is provided for general informational purposes only and does not constitute professional, financial, legal, mechanical, safety, or purchasing advice. Nothing on the Site should be relied upon as a substitute for consultation with a qualified professional.

Any decision to purchase, lease, finance, modify, service, or operate a vehicle is your own. You are solely responsible for operating any vehicle safely and in compliance with all applicable laws. Do not attempt to replicate any driving maneuver, performance test, or technique depicted on the Site on public roads.

11. Third-Party Links and Services

The Site contains links to third-party websites, content, and services that we do not own or control, including manufacturer sites, retailers, video platforms, and social media. We provide these links for convenience only. We do not endorse and are not responsible for the content, accuracy, products, services, or practices of any third-party site. Your use of third-party sites is governed by their terms and policies, not ours.

12. Availability of the Site

We do not guarantee that the Site will be available at all times or without interruption. We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice, and without liability to you.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT ANY CONTENT IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT.

14. Limitation of Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Test Miles and its owners, officers, employees, contributors, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

16. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a written notice to our designated agent containing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material claimed to be infringing and information reasonably sufficient to locate it on the Site
  4. Your contact information, including address, telephone number, and email address
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Please be aware that under 17 U.S.C. § 512(f), you may be liable for damages if you knowingly materially misrepresent that material is infringing. We may terminate access for users who are repeat infringers. If you believe your content was removed in error, you may submit a counter-notice containing the elements required under the DMCA.

17. Termination

We may terminate or suspend your access to the Site at any time, without notice or liability, for any reason, including breach of these Terms. Sections 5, 7.1, 9, 10, 13, 14, 15, 17, 18, and 19 survive termination.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law provisions.

You agree that any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Portland, Oregon, and you consent to the personal jurisdiction of those courts.

Any claim arising out of or related to the Site must be filed within one (1) year after the claim arises, or it is permanently barred.

19. General Provisions

  • Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Site and supersede all prior agreements on that subject.
  • Severability. If any provision is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.
  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control.
  • No Agency. No joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms.
  • Headings. Section headings are for convenience only and have no legal effect.
